St. Vincent Medical Group, Inc. v. United States Department of Justice
Ascension Medical Group sought to depose a DEA agent and a federal prosecutor in state court litigation. Their testimony would help Ascension prove that one of its doctors failed to disclose that he was under federal investigation, in violation of his employment agreement. The Department of Justice refused to make either employee available for depositions. Ascension sued to compel their testimony. The district court determined that the Department’s refusal was reasonable and entered judgment in its favor.The Seventh Circuit affirmed. Under 5 U.S.C. 301, each federal agency has promulgated “Touhy regulations,” governing when it will disclose information or make its employees available for depositions. The Department of Justice’s Touhy regulations are at 28 C.F.R. 16.21. Unless the Department unreasonably applied its Touhy regulations, a federal court is powerless to compel its participation in state court discovery. Because the Department reasonably applied its Touhy regulations to the particulars of Ascension’s request, its refusal was neither arbitrary nor capricious. The court noted that if the doctor denies that he was under investigation, Ascension can point to the DEA proffer letter he signed acknowledging that he was “a subject of a federal investigation.” View "St. Vincent Medical Group, Inc. v. Michelle Calderon v. Carrington Mortgage Services, LLC
Plaintiff sued Carrington Mortgage Services on behalf of the United States for alleged violations of the False Claims Act. Calderon is a former employee of Carrington. She alleged that Carrington made false representations to the U.S. Department of Housing and Urban Development (HUD) in the course of certifying residential mortgage loans for insurance coverage from the Federal Housing Administration (FHA). Carrington moved for summary judgment on the basis that Plaintiff did not meet her evidentiary burden on two elements of False Claims Act liability. The district court sided with Carrington on both elements and granted summary judgment, disposing of Plaintiff’s lawsuit.
The Seventh Circuit affirmed. The court concluded that Plaintiff does have sufficient proof of materiality. However, the court agreed that she has not met her burden of proof on the element of causation. The court explained that on the present record, it is not clear how a factfinder would even spot the alleged false statement in each loan file, let alone evaluate its seriousness and scope. And though Plaintiff asserted that the misrepresentations, in this case, are of the type identified in Spicer, the court did not see much in the record to support that point other than Plaintiff’s assertions. Without more evidence from which a jury could conclude that Carrington’s alleged misrepresentations in each loan caused the subsequent defaults, the nature of those misrepresentations is not enough to get past summary judgment. Combs v. Kijakazi
Combs suffers from several physical and mental impairments. An ALJ found that she suffers from lumbar spondylosis, asthma, migraines/headaches, chronic pain syndrome, diabetes with diabetic polyneuropathy, obesity, attention deficit hyperactivity disorder, schizoaffective disorder, bipolar type, posttraumatic stress disorder, social anxiety disorder, generalized anxiety disorder, and borderline personality disorder. Combs sought treatment for lower back pain in March 2018 at PPG, where she received various tests, treatments, and prescriptions through 2020.Combs applied for Disability Insurance Benefits in August 2019, alleging an onset of disability on December 24, 2015. The claim was denied initially and upon reconsideration. The district court concluded the ALJ’s determination was supported by substantial evidence. The Seventh Circuit affirmed, rejecting an argument that the ALJ should have concluded that Combs suffered a closed period of disability from June 2019 to July 2020 due to her back impairment, pain, and multiple invasive procedures that would have rendered her off task or absent beyond employer tolerances. The record amply supports the ALJ’s conclusion that Combs was not disabled at any time, including during that period. View "Combs v. Kijakazi" on Justia Law

T. S. v. County of Cook
Fox TV obtained permission from Superintendent Dixon to film scenes for the television series, Empire, at the Cook County Juvenile Temporary Detention Center. Fox used the Center’s outdoor yard, visitation room, medical office, and certain living spaces for five days and returned to film retakes on seven additional days. During filming, several housing pods housed more detainees than the Center’s policy suggested; some detainees exercised indoors instead of in the outdoor yard; some classes were moved; and the Center postponed or canceled some extra‐curricular activities and held visitation hours in a smaller room.Three detainees filed a proposed class action lawsuit under 42 U.S.C. 1983. The district court granted Dixon partial summary judgment on qualified immunity grounds because the plaintiffs had not shown “a clearly established right to be free of the arguably modest disruptions” but did not dismiss state law claims. The court reasoned that Dixon acted as the detainees’ guardian and had a fiduciary duty to “protect [them] from harm.” Under the holding, Dixon would only be entitled to sovereign immunity on the state law breach of fiduciary duty claim if he proved that he did not violate the detainees’ constitutional rights. On interlocutory appeal, the Seventh Circuit held that Dixon is immune from suit under the Illinois State Lawsuit Immunity Act. Grashoff v. Payne
People working part-time may qualify for weekly unemployment benefits, but must accurately report their income so the Indiana Department of Workforce Development can reduce their benefits accordingly. A claimant who knowingly fails to disclose earnings on a weekly application must repay all benefits received for that week and is subject to a civil penalty of 25% of that forfeited amount. Grashoff omitted her part-time income on 24 weekly applications. The Department determined that she knowingly violated the law and assessed a forfeiture and penalty totaling $11,190. An ALJ affirmed the sanction. Grashoff did not seek state judicial review but filed suit under 42 U.S.C. 1983 alleging that the sanction violates the Eighth Amendment’s Excessive Fines Clause. The district court rejected the claim, classifying the entire forfeiture as remedial rather than punitive. The penalty is a punitive sanction subject to Eighth Amendment scrutiny but is not grossly disproportionate to the seriousness of the offense.The Seventh Circuit affirmed. Grashoff conceded that the difference between the benefits she received and the smaller amount she would have received had she reported her income is purely remedial. The remaining forfeiture amount, even when considered together with the 25% penalty, is not a grossly disproportionate sanction for Grashoff’s knowing violations of the law. View "Grashoff v. Uetricht v. Chicago Parking Meters, LLC
During the 2008 recession, Chicago faced a $150 million shortfall in revenue and sought an alternative to raising taxes. The city awarded a 75-year Concession over designated parking spaces to the private firm CPM, which agreed to give Chicago an upfront payment of more than a billion dollars. After CPM took over, the price of parking in areas covered by the Concession more than doubled. Litigation in both state and federal courts followed. A federal class action filed by “two car drivers who live in Chicago,” asserted that CPM has violated the federal antitrust laws, 15 U.S.C. 1, 2.The Seventh Circuit affirmed the dismissal of the antitrust theories as barred by the state-action immunity doctrine. The Concession represents a use of municipal authority to substitute, during the term of the lease, exclusive private operation for direct city operation of specified areas of Chicago’s on-street parking facilities. It swaps one “monopolist” (Chicago) for another (CPM). Chicago had the authority to enter into the Concession and has reserved meaningful powers to oversee and regulate CPM’s performance. The court also theorized that there might not be a monopoly; Chicago cars can be found in apartment building parking garages, private residential garages, private lots, public lots, unregulated streets, and metered parking. Fetting v. Kijakazi
Fetting, 50 years old and suffering from back pain, headaches, depression, and anxiety, unsuccessfully applied for supplemental security income. During an administrative hearing, a vocational expert (VE) testified to Fetting’s physical and mental limitations and his ability to perform certain jobs, stating that Fetting could perform the representative occupations of a cleaner/housekeeper, routing clerk, and marker. The VE estimated that, in the national economy, there were 200,000 cleaner/housekeeper jobs, 40,000 routing clerk jobs, and 200,000 marker jobs. During cross-examination, the VE stated that he calculated his estimates from numbers published by the Bureau of Labor Statistics, using his “knowledge of the labor market, [acquired] over 30+ years of job placement activities.” He stated: “It’s not a hard and fast scientific type formula” and that he had not conducted any “formal analysis” to validate his estimates but had “in the past checked numbers in other reporting formats.”The ALJ found that Fetting did not have a disability under the Social Security Act based on the VE’s testimony. The district court and Seventh Circuit affirmed, rejecting an argument that the VE’s methodology for calculating his job number estimates was unreliable. National Labor Relations Board v. Haven Salon + Spa, Inc
In May 2020 Rehm expressed concern that Haven was not doing enough to protect her and other employees from COVID. Dillett, Haven’s Director of Operations and co-owner, did not appreciate Rehm’s suggestions. Rehm sent a staff-wide email criticizing Dillett’s handling of COVID health risks. Dillett fired her. After Rehm complained to the NLRB, Dillett threatened legal action. An ALJ found that Haven had unlawfully terminated and threatened Rehm, National Labor Relations Act, 29 U.S.C. 158(a)(1). The Board ordered Haven to compensate Rehm for lost pay and expenses, offer to rehire her, notify her that it had removed references to her unlawful termination from her employee file, post notices of employee rights, and file a sworn certification of compliance.The Seventh Circuit summarily enforced that order in September 2021. Haven did not comply. In December 2022, the Seventh Circuit directed Haven to respond to the Board’s contempt petition. Haven disregarded a subsequent “show cause” order. The Seventh Circuit entered a contempt order, requiring Haven to pay a fine of $1,000, plus a fine of $150 per day for every day of the next week that Haven fails to comply, beginning on February 28, 2023. The daily fine will increase by $100 each day that Haven fails to comply beyond the next week. Indiana Right to Life Victory Fund v. Morales
The Fund appealed the dismissal of its challenge to Indiana’s prohibition on corporate contributions to political action committees (PACs) for independent expenditures. Following oral argument, the Fund filed a “Motion Requesting Judicial Notice,” explaining that Morales has succeeded Sullivan as Indiana’s Secretary of State and has replaced Sullivan as a party to the case. Under Fed.R.App.P. 43(c)(2) the substitution happens automatically without any motion. The Fund sought judicial notice of the fact that there is no record evidence that Morales has taken any steps to disavow enforcement of Indiana’s Election Code prohibition on corporate contributions to PACs for purposes of independent expenditures.The Seventh Circuit denied the motion as “unnecessary” and “improper.” Nothing about Morales becoming Secretary of State calls jurisdiction into question. Nor does it materially alter anything about the issues. The Fund’s motion seeks one of two things, neither of which would be an appropriate use of judicial notice. It may attempt to define the likelihood that Secretary Morales will enforce the Election Code or it might attempt to highlight what it sees as a gap in the evidentiary record—that Secretary Morales has yet to make a statement regarding state regulation of independent-expenditure PACs. Sevec v. Kijakazi
Sevec filed for disability social security benefits, alleging an onset of disability in 2014. At the time of her hearing, Sevec was 60 years old and suffered from knee pain caused by osteoarthritis. Sevec stated that she worked as a registered nurse until 2014, doing narcotics counts, answering call lights and bed alarms, assisting patients to the bathroom; administering IV medications, doing breathing treatments; and taking care of feeding tubes. After leaving that job, she provided care for a neighbor. A vocational expert (VE) stated Sevec’s work as an RN was “level 7, medium in its physical demand, medium as performed. And then we also have home health nurse … also, level 6. Medium in its physical demand; light as performed.” The ALJ asked whether “any of the past work [would] be available?” The VE replied, “Possibly the home health being as performed at a light level, not per the [Dictionary of Occupational Titles], though, but as performed.”The ALJ concluded that Sevec was not disabled. The Appeals Council and the district court agreed. The Seventh Circuit reversed. The VE’s testimony is not well grounded in the record, and is not sufficient, standing alone, to support the ALJ’s determination. The record does not contain evidence from which the ALJ could determine, with any degree of confidence, that Sevec is capable of performing her past work; the ALJ specified that her “past work” did not include "home health nurse."
