In 1982 Hobbs was working as a photographer on a Russian cruise ship where he had a brief affair with a Russian waitress. Based on the experience, he wrote a song, “Natasha” about an ill-fated romance between a man from the U.K. and a Ukrainian woman. In 1983, he registered his copyright to “Natasha” in the United Kingdom and sent the song to several music publishers, including a company that published songs composed by Elton John and Bernard Taupin. Hobbs’s efforts to find a publisher for “Natasha” were unsuccessful. In 1985, Elton John released his very successful song, “Nikita,” in which a singer from “the west” describes his love for Nikita, whom the singer saw “by the wall” and who is on the other side of a “line” held in by “guns and gates.” Hobbs filed a copyright infringement claim 27 years later. The district court dismissed. The Seventh Circuit affirmed, finding that the songs were not substantially similar. The Copyright Act does not protect general ideas, such as a romance between a western man and a woman from behind the iron curtain, but only the particular expression of an idea. View "Hobbs v. In 2006 a teenager accused Gakuba of kidnapping and raping him. State charges are pending Gakuba sued under 42 U.S.C. 1983, claiming that investigating police barged into his Rockford hotel room without a warrant and seized his wallet and other items after obtaining Gakuba’s video rental records from Hollywood Video to corroborate the accuser’s story that he had spent time watching videos in Gakuba’s room. He also sought damages under the Video Privacy Protection Act, 18 U.S.C. 2710. The district court dismissed without prejudice, granting Gakuba leave to amend his complaint if the indictment concluded in his favor. The court advised Gakuba that certain claims would be barred on immunity grounds. The Seventh Circuit vacated. Gakuba’s claims of damages resulting from illegal searches, seizures, and detentions involve constitutional issues that may be litigated during the course of his criminal case. Monetary relief is not available to him in his defense of criminal charges and his claims may become time-barred by the time the state prosecution has concluded, so the district court should have stayed rather than dismissed Gakuba’s civil-rights claims. In 2004, Harmon contracted to provide Chicago Bulls rookie Gordon with financial and consulting services for the “duration of [his] playing career,” but outlining a compensation arrangement only for the length of Gordon’s rookie contract with the Bulls, which ended in 2008. In 2007, Gordon became dissatisfied with Harmon’s services, based in part on what he viewed to be a breach of a fiduciary duty relating to a bad investment, and prematurely terminated the agreement. Gordon sued first, claiming Harmon had breached a promissory note between the parties and had breached his fiduciary duties. Harmon asserted counterclaims for breach of the agreement and tortious interference with prospective business advantage. The district court dismissed Harmon’s counterclaims. Harmon refiled his breach of contract claim in Illinois state court and also alleged malicious prosecution, abuse of process, and tortious interference with prospective business advantage. After Gordon removed the case to federal court, the district court ruled in favor of Gordon, concluding that the parties had intended their agreement to last only for the length of Gordon’s rookie contract. Eastland is the proprietor of the rap duo Phifty-50, which, according to its web site, has to its credit one album (2003) and a T-shirt. Eastland has registered “PHIFTY-50” as a trademark. It also claims a trademark in “50/50” and contends that Lionsgate and Summit infringed its rights by using “50/50” as the title of a motion picture that opened in 2011. The district court dismissed, finding the movie’s title descriptive because the film concerns a 50% chance of the main character surviving cancer. The Seventh Circuit affirmed, stating that the complaint fails at the threshold: it does not allege that the use of “50/50” as a title has caused any confusion about the film’s source, and any such allegation would be too implausible to support costly litigation. The phrase 50/50 or a sound-alike variant has been in use as the title of intellectual property for a long time. If there is any prospect of intellectual property in the phrase 50/50, Eastland is a very junior user and in no position to complain about the 2011 film. View "Eastland Music Grp. LLC v. Bogie attended a comedy show featuring Joan Rivers, who told a joke about Helen Keller, offending an audience member who had a deaf son. The audience member heckled Rivers; their brief exchange was filmed and was part of the documentary. When Rivers exited to a backstage area, closed to the public, Bogie gained entry and expressed frustration with the heckler and sympathy for Rivers. Rivers responded with an expression of sympathy for the heckler. The film shows at least three others present. The interaction was filmed and included in the documentary entitled Joan Rivers: A Piece of Work. Bogie’s conversation lasted 16 seconds in the film’s 82 minutes, 0.3 percent of the entire film. The documentary was distributed nationwide. Bogie alleges that she was portrayed in the film as having approved of condescending and disparaging remarks by Rivers toward Wisconsin, its citizens, and the heckler. Bogie’s complaint alleged that her privacy was invaded by the distribution of the film and that the film misappropriated her image for commercial purposes without her consent. The district court dismissed. The Seventh Circuit affirmed, reasoning that the footage was “incidental,” newsworthy, and not used for advertising. View "Bogie v. Rosenberg" on Justia Law

In 2006 Vince P, wrote, recorded, and distributed a song entitled Stronger. The title comes from a line in its refrain that draws from an aphorism coined by Friedrich Nietzsche: “what does not kill me makes me stronger.” Vince P began looking for an executive producer in the hip-hop recording industry and sent a recording to Monopoly, a business manager and friend of Kanye West, a hip-hop superstar. Monopoly agreed to be Vince P’s producer, so long as Vince P was funded by a record label. That funding never materialized and the proposed collaboration foundered. Shortly thereafter, Kanye West released a song entitled Stronger. West’s song also features a hook that repeats the Nietzschean maxim and, according to Vince P, other suspicious similarities to his song. Vince P tried to contact West, but he was turned away by West’s representatives. In response, Vince P registered a copyright for his version of Stronger and sued West. The district court dismissed. The Seventh Circuit affirmed. The two songs are not similar enough to support a finding that copyright infringement has occurred under 17 U.S.C. 106(1); the songs share only “cosmetic similarities.” View "Peters v. Plaintiffs were high school football players that earned scholarships to play for National Collegiate Athletic Association Division I football programs. Both suffered career-ending football injuries at college. Their athletic scholarships were good for one year. When injuries prevented them from playing football, their scholarships were not renewed. Plaintiffs challenge two NCAA regulations as having an anticompetitive effect, in violation of the Sherman Act. 15 U.S.C. 1: the cap on the number of scholarships given per team and the prohibition of multi-year scholarships. The district court dismissed, finding that plaintiffs failed to allege a relevant commercial market on which NCAA Bylaws had an anticompetitive effect. The Seventh Circuit affirmed. It was not clear whether plaintiffs believed that the Bylaws affect an overall market for degrees, which would impact scholarship athletes and non-athletes alike, or some market that only concerns athletes attempting to obtain education in exchange for athletic services. Plaintiffs claimed that they alleged that there was no practical alternative for students wishing to pursue an education in exchange for playing ability, but the complaint explained the lack of practical alternatives for colleges wanting to field teams outside of the NCAA framework, not the lack of alternatives for student-athletes.

An episode of the animated television show, South Park, entitled “Canada On Strike,” satirized the 2007-2008 Writers’ Guild of America strike, popular viral videos, and the difficulty of monetizing Internet fame. In the episode, characters create a video that is a parody of the real world viral video, “What What (In The Butt),” Brownmark, the copyright holder for the original WWITB video, sued for copyright infringement under the Copyright Act of 1976, 17 U.S.C.101. SPDS claimed that the South Park version was fair use and attached the two works. Brownmark argued that the court could not consider fair use on a 12(b)(6) motion to dismiss. The district court dismissed. The Seventh Circuit affirmed the “well-reasoned and delightful opinion.” The court properly decided fair use on a motion; the only evidence needed to decide the issue were the original version of WWITB and the episode at issue. Under the incorporation-by-reference doctrine, reliance on the attached works did not violate Rule 12(d); if a plaintiff mentions a document in his complaint, the defendant may then submit the document to the court without converting defendant’s 12(b)(6) motion to a motion for summary judgment.

Redbox rents DVDs, Blu-ray discs, and video games from automated retail kiosks and was sued under the Video Privacy Protection Act, 18 U.S.C. 2710. The district court held that Act provisions requiring destruction of records containing personally identifiable information can be enforced by suit for damages. After deciding to accept the interlocutory appeal because it will materially advance the ultimate termination of the class action, the Seventh Circuit reversed. The court noted the placement of the damages remedy in the statute, after description of a prohibitions on knowing disclosure of personally identifiable information, but before prohibition on use of such information before tribunals or the record-destruction mandate. The court also noted the "unsuitability" of those provisions to damage awards.

In 1993 a hip-hop group released a track that contains a segment of plaintiff's 1969 song. The district court dismissed plaintiff's 2003 copyright suit. Under the Copyright Act, sound recordings fixed before February 15, 1972 are not subject to copyright protection, but may be protected by state law (17 U.S.C. 301(c)). The court denied a motion to amend and awarded $321,995.25 in attorneyâs fees and $10,620.53 in costs. A new claim, filed in state court, was removed to federal court and dismissed as res judicata. The Seventh Circuit affirmed. The trial court correctly denied the motion to amend, based on the undue delay between the plaintiff's notice of the defects in his claim and the motion. The fact that the material was not under copyright did not deprive the court of jurisdiction and the second complaint was properly dismissed.
